The Partners at CCHL are available to act as both Independent Guardians and Councilors on Foundation Councils

The regulations around Foundations in both the ADGM and the DIFC require a Foundation Council of at least two members with a Guardian and a Councillor, although the rules are slightly different. In many cases, Founders wish to have independent Councillors and, where needed, Independent Guardians to ensure that the Foundation is being managed in lines with its Charter and, in addition, to advise on how the Foundation manages its underlying assets.
The Partners at CCHL are available to act as Independent Trustees on Private Trust Companies
Private Trust Companies (PTCs) are entities whose sole purpose is to act as a Trustee to an individual Trust or group of Trusts. They are usually used by Families to hold underlying shares in the Family Enterprise as well as other Family-owned assets.
For Families, the principal benefit of a PTC is to allow the Settlor to keep more control over the underlying Trusts by acting as the Trustee themselves. Thus, PTCs allow Family Members to be included in the decisions around how the Trust is administered.
Nonetheless, PTCs are still Trusts and subject to the relevant Trust laws of the jurisdiction and usually have professional Corporate Trustees to ensure the proper administration of the Trust in line with local regulatory requirements.
Many Families also desire to have an Independent Trustee as well in order to ensure independent oversight of the administration of the PTC and management of the underlying assets. In addition, Independent Trustees can offer impartial advice to the Family on the management of the PTC, the underlying Trusts and their holdings.
